Conditions of Sale (covering vendors).

All goods accepted by Biddle & Webb Ltd will be subject to the following terms & conditions of acceptance:

1. Biddle & Webb Ltd has a varied commission rate which is subject to alteration from time to time.  Our present standard rate for all specialist sales is 16% with a minimum charge of £10.00 per lot whether sold or unsold.  General sales and Collectors sales have a standard commission rate of 22% with a minimum charge of £10.00 per lot whether sold or unsold.  VAT is payable on all commission charges.

2. WARRANTY OF TITLE.
(a) The vendor guarantees Biddle & Webb Ltd and the purchaser that he/she is the true owner of the goods or is legally authorised to sell on the true owners behalf and that all such goods are free from any third party claim.
(b) The vendor will indemnify Biddle & Webb Ltd, its servants & agents against any loss or damage incurred in consequence of a breach of (a) above.

3. INSTRUCTIONS. 
As Biddle & Webb Ltd are auctioneers, all items delivered to their premises will be deemed to be delivered for sale by auction unless otherwise stated in writing.  All goods will be entered into those sales which Biddle & Webb Ltd consider the most suitable and sold at the auctioneer’s discretion.

4. INSURANCE.
Unless instructed otherwise (in which case the goods remain at the vendor’s or consigner’s risk) goods will be insured against all risk whilst on the premises pending the sale.  In no event will Biddle & Webb Ltd be liable for damage to glass or picture frames.  The premium cost for insurance will be at the rate of £1.00 per £100 calculated on the hammer price (minimum charge £1.00)
Biddle & Webb Ltd shall not be responsible for damage to, or the loss, theft or destruction of any goods not so insured.  If the vendor or consigner has in force a policy or policies of insurance in which the article is specifically mentioned as being insured (whether or not for an agreed sum of value) the vendor shall notify his/her insurers of and shall him/herself note the auctioneer’s interest as bailee in such policy or policies.

5. STORAGE. 
Biddle & Webb Ltd reserve the right to store any goods delivered to them for sale either on their own premises or elsewhere at their sole discretion.  Biddle & Webb Ltd reserve the right to make a minimum storage charge of £2 per lot per day.

6. RIGHT TO SELL.
Vendors may be charged a minimum fee of £2 per item per day for goods left on Biddle & Webb Ltd’s premises after the vendor has been asked to remove them either verbally or in writing.  If such goods are not removed within 14 days after such request Biddle & Webb Ltd reserve the right to sell such goods without further notice at their absolute discretion to defray their costs and charges.

7. All goods are offered for sale without reserve unless written instructions are received by Biddle & Webb Ltd prior to the commencement of the sale.  A reserve once placed cannot be changed without the full consent of Biddle & Webb Ltd.  Reserves placed by telephone are accepted at the sole risk of the vendor and must be confirmed in writing to be received at least one hour prior to the commencement of any sale.  Reserves are subject to auctioneers discretion of 10% or one bid, whichever is the greater.  No lot can be reserved with a value of £30 or less.

8. INDEMNITY. 
The vendor will indemnify Biddle & Webb Ltd against any claims in connection with any goods sold on the vendor’s behalf made by a third party howsoever arising.

9. The vendor authorises Biddle & Webb Ltd to deduct commission and expenses at the agreed rates from the price realised and acknowledge the right of Biddle & Webb Ltd to retain all premiums payable by the purchaser.

10. DEFAULT.
Biddle & Webb Ltd disclaim responsibility for any default by either vendor or purchaser as they act solely as agents.  Biddle & Webb Ltd disclaim liability for paying the vendor until full payment is received from the purchaser.

11. RIGHT TO PHOTOGRAPHS AND ILLUSTRATIONS.
The vendor gives Biddle & Webb Ltd full authority to photograph or illustrate any lots placed in their hands for sale and to use such photographs or illustrations at their absolute discretion, whether or not in connection with the auction.  Biddle & Webb Ltd will reserve the right to make a discretionary charge for any photographs used in the catalogue or supplied to prospective buyers which will promote the items sale.
